Raj HC rejects plea demanding stay on govt’s mobile tower bylaws
Jaipur: In a setback to telecom companies, the Rajasthan High Court rejected applications of Cellular Operators Association of India and Association of Unified Telecom Service Providers of India seeking a stay on state government’s mobile tower bylaws.
COAI and AUSPI requested the court to stop implementation of bylaws. They said they had filed petitions challenging legality of the bylaws made by the government on August 30, 2012. Until the petitions are decided, the implementation of the bylaws should be stayed.
The division bench of Chief Justice Arun Mishra and Justice NK Jain (I) rejected cellular operators’ pleas. HC expressed anguish on COAI’s request to postponed the hearing as their lawyer Gopal Subramaniam failed to come from Delhi. The case was listed only after Subramanium had agreed. However, HC scheduled the hearing for November 23.
