Delhi gang-rape: Juvenile raped victim twice; was most brutal among 6 men

New Delhi: He might walk free in three months but he was the most brutal among six men who gang-raped the 23-year-old medical student in South Delhi on December 16.
According to the Delhi Police, the juvenile raped the student twice. Once she was unconscious, he extracted her intestine with his hands and suggested she be thrown off the moving bus sans her clothes, says the chargesheet that the police are supposed to file in court today.
The police are yet to receive the report of his bone ossification test and are treating him as a juvenile on the basis of his school leaving certificate.
The police have also obtained the initial postmortem report from Singapore.
Being a minor his trial will be held at the Juvenile Justice Board under the Juvenile Justice Act.
The Juvenile Justice Act has a provision for a maximum sentence of 3 years irrespective of the offense.
Even though the accused is only months away from turning major, but since the law takes cognisance of the age at the commission of offense his trial will be held under the Juvenile Act.
However, since he would be a major by the time he is convicted he cannot be kept at the remand home for boys, and will be kept in Delhi's Tihar jail.
